The Case Study (Overview)

Our client, lacking an internal HR department, was faced with a distressing issue: an employee, Sarah, reported ongoing harassment from a colleague, John, her former boyfriend. Despite management’s initial efforts to intervene, John’s behaviour persisted, leading to a formal complaint.

At this point, the company turned to Insight HR for help.

Key Lessons Learned

Act Quickly and Reassure Employees:
Early intervention is critical. We advised the client to immediately provide Sarah with the company’s Dignity at Work policy and reassured her that her concerns were being taken seriously.

Ensure Impartial and Thorough Investigations:
Our impartial investigation included interviews, review of communication logs, and adherence to best practices. This not only uncovered the truth but also ensured fairness for all involved.

Separate Roles in Investigation and Disciplinary Processes:
After confirming misconduct, we guided the company through a compliant disciplinary process, ensuring there was a clear separation between the investigator and the decision-maker.

Prioritise Employee Well-Being:
Both Sarah and John were provided access to an Employee Assistance Programme (EAP), ensuring emotional support during the process.

The Outcome

The disciplinary process concluded with John’s dismissal. When he appealed and later filed a claim with the Workplace Relations Commission (WRC), the company’s robust documentation and adherence to best practices protected them from liability.
